Lotus Pond is operated by NexThought LLC ("Lotus Pond," "we," "us," or "our"). These Terms of Service (the "Terms") are a binding agreement between you and NexThought LLC covering your use of the Lotus Pond browser extension, website, dashboard, and related services (together, the "Service").
Please read section 15 carefully. It limits the amount we can be held liable for, and section 17 sets out how disputes are resolved.
By installing the extension, creating an account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal information; please read it.
If you are agreeing on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
Lotus Pond is offered only to people who live in the United States. By creating an account you confirm you live in the United States and that the state or territory you give us is where you live. The United States includes the District of Columbia and the US territories.
You must be at least 13 years old to use Lotus Pond. If you are 13 to 17, you may use Lotus Pond and agree to these Terms yourself. You need a parent or guardian's permission only to buy a paid plan, as set out under Plans and billing. Using your reports to train Lotus Pond's filtering is offered only to users aged 18 or older.
You may not use the Service if you are barred from doing so under applicable law, or if we have previously terminated your account.
Lotus Pond is a content filtering tool. The browser extension reads the feeds you are already viewing on supported platforms, currently YouTube and Reddit. Basic filters, which match keyphrases you choose, are matched in your browser, and an item checked only by basic filters is not sent to our servers. For the items your smart filters check, the extension sends information about those items to our servers. We analyze those items using automated systems, including third-party artificial intelligence services, and return a decision about whether each item matches the filters you configured. The extension then hides matching items from your view.
Filtering happens only in your own browser, for your own feeds. Lotus Pond does not remove, report, demote, or alter anything on the underlying platform, and has no effect on what anyone else sees.
Filtering decisions are produced by automated and probabilistic systems. They are not perfect and will not match human judgment in every case.
Lotus Pond is a preference tool, not a safety tool. Content you asked to avoid may still reach you, and content you wanted to see may be hidden.
Do not rely on the Service as a child-safety control, a content-moderation system, an accessibility aid, or any other protective measure where a missed item could cause harm. It is not designed, tested, or offered for those purposes.
If the Service gets something wrong, you can report it from the extension or from our contact page. Reports help us improve, but we do not promise any particular accuracy rate or turnaround.
When our review team finds that the Service judged an item wrongly, it may correct the stored decision for that item, and the correction applies to everyone whose filter has the same wording. A correction changes only whether that item is hidden by Lotus Pond, never anything on the platform itself.
You need an account to use the Service. You agree to provide accurate information, to keep it current, and to keep your credentials secure. You are responsible for activity that happens under your account.
Tell us promptly at [email protected] if you believe your account has been used without your permission.
Some features require a paid subscription. Prices and plan limits are shown on our pricing section at the time you subscribe. If you are under 18, you need a parent or guardian's permission to buy a paid plan, and they are responsible for the payment.
Payments are processed by Stripe. We do not receive or store your full card number. Your use of Stripe's payment services is subject to Stripe's own terms and privacy policy.
Subscriptions renew automatically at the end of each billing period at the then-current price, until cancelled. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the period you have already paid for; you keep access until then.
Except where required by law, payments are non-refundable and we do not provide partial refunds for unused time. If you believe you were billed in error, contact us within 30 days and we will review it in good faith. If someone under 18 bought a paid plan without a parent or guardian's permission, that parent or guardian may contact us within 30 days of the charge and we will refund it in full.
We may change prices. If we do, we will give you at least 30 days' notice before the change applies to your subscription, and the new price takes effect at your next renewal. If you do not agree, you may cancel before that renewal.
Prices exclude taxes unless stated otherwise. You are responsible for any applicable sales, use, or value-added taxes.
You agree not to:
We may suspend access immediately if we reasonably believe your use threatens the security, availability, or integrity of the Service or of other users.
Lotus Pond is not affiliated with, sponsored by, or endorsed by Google LLC, YouTube, or Reddit, Inc. YouTube is a trademark of Google LLC and Reddit is a trademark of Reddit, Inc.
Your use of those platforms remains governed by their own terms. You are responsible for making sure your use of the Service alongside them complies with those terms.
Lotus Pond uses YouTube API Services to look up the name and picture of YouTube channels you add to your greenlist. By using Lotus Pond you agree to be bound by the YouTube Terms of Service. Google's handling of those requests is described in the Google Privacy Policy.
The Service depends on the structure of pages we do not control. When a platform changes its layout, its APIs, or its policies, parts of the Service may stop working, with or without notice. We will make reasonable efforts to restore functionality, but we cannot guarantee continued compatibility with any platform.
You keep all rights you already hold in the content you submit or that the extension reads on your behalf. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, and process that content for the sole purpose of operating and improving the Service, including sending it to the third-party AI providers described in our Privacy Policy.
This license exists only so the Service can function. It ends when the relevant content is deleted from our systems. We do not sell your content.
For each report you send while training is switched on in your account settings, you also grant us a license to use that item, its picture included when the report carries one, to train and test AI models once our review team has labeled it. Otherwise we do not use your content to train or test AI models. Turning training off ends that license for those items and removes them from those sets; it does not undo training already done with them. The choice is yours, and is described in our Privacy Policy.
How we handle personal information is described in the Privacy Policy.
The Service, including its software, design, and the Lotus Pond name and logo, is owned by NexThought LLC and protected by intellectual property law. Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to use the Service for your own use. No other rights are granted.
If you send us suggestions or ideas about the Service, we may use them without restriction or obligation to you. This does not give us any rights in your existing intellectual property.
We may add, change, or remove features. We may also update these Terms. If a change is material, we will give reasonable notice, by email or in the product, before it takes effect, and we will update the "last updated" date above.
Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and cancel any subscription.
You may stop using the Service and delete your account at any time from your dashboard, or by writing to [email protected].
We may suspend or terminate your account if you materially breach these Terms, if we are required to by law, or if we discontinue the Service. Except where a breach makes it impractical, we will give you notice and, where the problem can be fixed, a reasonable chance to fix it. If we terminate for convenience, or discontinue the Service, we will refund any prepaid fees covering the period after termination.
Sections 9, 10, 14, 15, 16, 17, and 18 survive termination.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that filtering will be accurate or complete, or that it will remain compatible with any third-party platform.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, NexThought LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Service, whether or not we were advised such damages were possible.
Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or 100 US dollars.
These limits apply regardless of the legal theory and even if a limited remedy fails of its essential purpose. Nothing here limits liability that cannot be limited by law, including liability for fraud, gross negligence, or willful misconduct. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold harmless NexThought LLC and its officers, employees, and agents from any claim, loss, or expense, including reasonable legal fees, arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right. We will notify you of any such claim and you may control the defense, provided any settlement that imposes obligations on us requires our consent.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Leon County, Florida have exclusive jurisdiction over any dispute, and both parties consent to that venue.
Before filing anything, please contact us at [email protected]. Most issues can be resolved quickly. If we cannot resolve a dispute within 30 days, either party may pursue it formally.
Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction, or affects your right to bring a claim in a small claims court, or any non-waivable right you have to bring a claim in the courts of your country of residence.
These Terms are the entire agreement between you and us about the Service, replacing any earlier agreement on the subject.
If a provision is found unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.
Not enforcing a provision is not a waiver of our right to enforce it later.
You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets, on notice to you.
Neither party is liable for delays or failures caused by events beyond its reasonable control.
These Terms do not create a partnership, agency, or employment relationship, and there are no third-party beneficiaries.
Questions about these Terms can go to
[email protected], or through
our contact page.
